Information clause
Your personal data may be transferred by Currency Lending sp. z o.o. (hereinafter referred to as the 'Company') to Biuro Informacji Kredytowej S.A. with its registered office in Warsaw, 77a Zygmunta Modzelewskiego Street, 02-679 Warsaw (hereinafter referred to as the 'BIK') under Article 9a(8) of the Consumer Credit Act of 12 May 2011 (hereinafter referred to as the 'Consumer Credit Act') or alternatively under your consent granted by you pursuant to Article 59b(2) of the Consumer Credit Act.
Pursuant to Article 9a(8) of the Consumer Credit Act, a lending institution that has granted consumer credit is obliged to promptly provide information on the consumer credit granted to the BIK, which is the institution referred to in Article 105(4) of the Act of 29 August 1997 - Banking Law (hereinafter: 'Banking Law'). Information on arrears in repayment of this credit may also be forwarded to the BIK.
If you have granted the consent referred to in Article 59b(2) of the Consumer Credit Act, your personal data may be transferred to the BIK:
- in order for BIK to provide the Company, in response to the enquiry submitted, with information concerning you, including information which constitutes bank secrecy, for creditworthiness assessment and credit risk analysis and/or;
- in order for BIK to process data relating to your obligation under the concluded loan agreement.
Therefore, BIK - in addition to the Company - will become the controller of your personal data. Below, you will find information concerning the processing of your personal data by BIK:

Data recipients | Your personal data may be made available by BIK to entities authorized to receive it on the basis of your consent, that is to banks, institutions authorized by law to grant credits, credit institutions, loan institutions and entities referred to in Article 59d of the Act of 12 May 2011 on consumer credit, as well as to the PESEL register or ID Cards Register in order to verify correctness of the personal data provided. Your personal data may also be submitted to entities which process data on behalf of BIK, such as IT service providers – with the proviso that such entities process data as subcontractors on the basis of a contract concluded with BIK and only according to BIK instructions. |
Rights of the data subject |
You have the right to access your data and the right to demand its rectification, deletion and restriction of processing. To the extent to which the basis for the processing of your personal data is the premise of a legitimate interest of the controller, you have the right to object to the processing of your personal data. To the extent to which the basis for the processing of your personal data is consent, you have the right to withdraw your consent. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. To the extent to which your data is processed for the purpose of conclusion and performance of the contract or processed on the basis of the consent – you also have the right to transfer your personal data, that is to receive your personal data from the controller in a structured and commonly used machine-readable format. You may send this data to another data controller. The right to transfer data does not apply to data being a business secret. You also have the right to file a complaint with a supervisory body responsible for the protection of personal data. |
