Conotoxia Holding has filed a notice of suspicion of crime with the National Prosecutor's Office against a group of Financial Supervision Authority employees and the president of one of the banks, who lobbied for the revocation of the group company's license.
The charges include:
- Blatant violation of administrative law in revoking the license.
- Public dissemination of false information.
- Exerting pressure and forcing abbreviated deadlines for implementation of inspection recommendations, including receipt of letters.
- Public disclosure of classified information regarding the proceedings.
- Filing a false report by the FSA on suspicion of a crime.
- Suspicion of espionage activities by an employee of the FSC and the president of one of the banks for the benefit of a foreign state.
The aforementioned acts or omissions may fulfil the elements of crimes under Article 231 § 1 or 2 of the CC, Article 238 § 1 of the CC, Article 266 § 2 of the CC, Article 229 of the CC and Article 130 of the CC.
The holding's owners estimate that they have suffered losses of at least several billion PLN due to the described activities and request prosecution of all those involved.
Cyber attacks
Conotoxia Holding reports that due to the tense geopolitical situation and the ongoing war in Ukraine, it has been in contact with representatives of the Internal Security Agency. Some time ago, we received a verbal warning from the Agency employee about possible hybrid attacks on our company. Indeed, cyber-attacks targeting the company's infrastructure did take place, but they were successfully blocked by security systems (firewalls).
An appeal to the Prime Minister
Conotoxia Holding points out, however, that it did not anticipate the “attack” by the FSA and the president of the bank as mentioned above, which, as it turns out, could have proved far more dangerous and led to the actual elimination of the company with 100% Polish capital from the payment services market.
In light of these accusations, we demand the immediate suspension of all designated employees of the Authority. In the face of the current Chairman of the FSA and the officials voting for the revocation of licenses, who formally cannot be suspended, the company requests their dismissal from office by Prime Minister Donald Tusk. Conotoxia Holding stresses that those responsible are still in power, making it difficult for the company to defend itself, including by delaying the transfer of documents to the court.
Call for the appointment of a parliamentary commission of inquiry
Our group calls for the Parliament of the Republic of Poland to appoint a special investigative committee to examine the circumstances and legality of the Financial Supervision Authority’s decisions made to the company's detriment. According to Conotoxia Holding, the facts and irregularities in administrative procedures uncovered during the proceedings may indicate gross violations, harming the interests of Polish entrepreneurs, consumers and the security of the financial market.
