Cinkciarz.pl, Conotoxia sp. z o.o. and Conotoxia Holding strongly oppose the disclosure of case file no. 2007-2.ds.21.2024 by the Regional Prosecutor's Office in Poznan.
In our opinion, such action is unjustified and violates our interests, as it may lead to the disclosure of important elements of the companies' trade secrets. Furthermore, the public prosecutor's office did not provide the legal basis for making the files available in its announcement. The cited provisions of Article 131(2) and (3) of the Code of Criminal Procedure (CCP) concern only the specific method of providing information on the rights of multiple aggrieved parties. The decision to make the file available to the parties to the proceedings before the end of the preparatory proceedings is based on fulfilling the conditions of Article 156(5) of the CCP, which are not met in the case in question.
Additionally, the Conotoxia Holding group includes Conotoxia, Inc., based in the USA, which provides a money transfer service and has used Conotoxia sp. z o.o. and Cinkciarz.pl sp. z o.o. as agents for international transfers to Europe. Releasing files containing confidential information about the group's global operational structure will violate international financial data protection and corporate secrecy laws.
More importantly, disclosing these data could cause serious harm to Conotoxia, Inc. in the USA and Conotoxia Ltd. in Cyprus, which are part of the group. These companies operate under US and EU regulations, both of which provide for strict protection of confidential information, especially with regard to financial services and cross-border money transfers. Therefore, we believe that the release of the files may violate US and European regulations on data protection and banking secrecy, as well as brokerage secrecy, and may, therefore, harm the interests of our foreign entities.
